I came across a great article on governing. This article made me realized that urban communities do in fact have programs to help deter future criminals but the programs are just simply broken. Scared Straight is a program intended to deter juveniles from participating in future crimes. Juvenile and at-risk youth visits prisons and observes first-hand prison life and interacts with adults prisoners.

The Scared Straight intervention was found to be more harmful than doing any good. The Scared Straight programs are not deterring youth from future violation of the law, but it is oddly increasing the chances of the juvenile ending up behind bars. The million dollar question is why still fund programs that have been found to be more harmful than doing any good?

The main reason why programs like Scared Straight continue to be funded and supported by the government is that strong constituencies back the interventions. Police can question a child without a parent present and are not required to obtain permission from a parent before questioning the child. Students in U. The courts have recently expanded the right of school officials to conduct student searches, resulting in part from recent acts of school violence and heightened public scrutiny.

Seizures by law enforcement officers are generally broken down into three categories: consensual encounters, investigatory detentions, and arrests. The degree of intrusion increases with each. To initiate each type of seizure, the officer must meet the appropriate reasonableness requirement discussed below. An unreasonable search and seizure is a search and seizure by a law enforcement officer without a search warrant and without probable cause to believe that evidence of a crime is present.

The Constitution, through the Fourth Amendment, protects people from unreasonable searches and seizures by the government. The Fourth Amendment, however, is not a guarantee against all searches and seizures, but only those that are deemed unreasonable under the law.
